In a federal court case in California,
Judge Carter issued an order about plaintiff
Eastman's compliance with a supboena.
According to the order's  background facts (page 3, line 1, to page 11, line 12),
plaintiff John C. Eastman and
president Donald J. Trump attempted a coup.

According to the order, the violence on 6 January 2021
in the Capitol (the building in which Congress meets)
was caused by Eastman and Trump
as part of their coup attempt.

The violence caused deaths.
American law has a felony murder rule:  if a felony causes a death,
the felon is guilty of first degree murder.
In our opinion:  if Judge Carter is right about the coup attempt,
Eastman and Trump are guilty of first degree
murder because their felonious, coup attempt caused five deaths.
