    Because our Evans pages were created when she was in the Assembly, they often, anachronistically refer to her as an asemblyperson. Now (March 2014), she's a state senator.

    Evans represented assembly district 7, of which a map is available from California Voter Foundation's California Map Series. Evans was born in San Diego on 22 April 1955 and supposedly has lived in Santa Rosa (Sonoma county) since 1982. She lives with her husband, has 3 kids, bachelor's degree in 1978 (therefore born about 1956?), now (1 October 2005) an active lawyer (number 102385, of counsel to Lanahan & Reilley law firm according to that law firm's website on 1 October 2005), formerly affiliated with Fudem and Evans law firm (Santa Rosa, CA 95404) according to records of a financial contribution, former member of Santa Rosa city council, e-mail evanifudem@sonic.net. We don't know if she became affiliated with Lanahan & Reilley law firm before or after she was elected to the Santa Rosa city council. The firm has politically contributed to her since at least July 2003, when she was on the Santa Rosa city council. It is interesting that the Lanahan & Reilley firm contributes to help its lawyer Evans win election to the assembly (interesting because, after she won, she may have had had less time available to work for the firm). On 31 August 2005, the law firm's website, on its page for its lawyer Evans, trumpets that she is in the state assembly.

This was recorded as a donation (a gift) from Evans's committee, not an expenditure by that committee. Other Democratic assembly members' committees made gifts of the same amount to the same recipient. For example, a donor (FRIENDS OF FABIAN NUNEZ 2004, BEVERLY HILLS, CA 90211) gave that amount to that recipient in spring 2003 (March 27) and spring 2004 (April 8).

    1. Sean MacNeil is her chief of staff. He lives in Vallejo city. His email address is Sean.MacNeil@asm.ca.gov. He went to college in Davis town of California. (Someone named Sean M. MacNeil lived in Davis.) Evans's MacNeil was Patricia Wiggins's chief of staff. Patricia Wiggins repesented the same assembly district which Noreen Evans now represents (assembly district 7). In the 2004 Democratic primary for district 7, Noreen Evans ("Councilwoman/Mother/Attorney") ran against Jim Leddy ("Santa Rosa School Board Member").

      (Notice that Evans explicitly campaigned as a mother.)

      The incumbent Patricia Wiggins did not run in the primary because she was term-limited under California law.. Wiggins is now (October 2005) a candidate for the state senate, suggesting that she retains a desire to be in the state legislature.     Jackie Goldberg represents state assembly district 45 (an amazingly gerrymandered district, incidentally). Her district (in Los Angeles county) is hundreds of miles from Evans's district 7 (in northern California). Goldberg's campaign committee gave one thousand dollars to Evans's geographically distant, campaign committee. Goldeberg's committee was supposed to help Goldberg's re-election campaign (which is why contributors gave money to it). We do not know how, if at all, the thousand dollar contribution helped Goldberg's re-election campaign. If the thousand dollars did not help Goldberg's get re-elected, then maybe income tax law requires that the Goldberg committee possibly should pay income tax on the income, we think. The Evans committee reported the payment as a contribution (not, for example, as a payment for a service by Evans). In the absence of service by Evans, how did the Goldberg committee's payment help Goldberg's re-election campaign?

    For the contribution to be illegal, it is sufficient that it was not intended to help Goldberg get reelected. There is no need to know what the payment was intended to accomplish. Another, separate way to show illegality would be by showing (if it be true) that the Goldberg committee's contributors had not been told that the committee's money would largely be paid to non-Goldberg political entities (for example, paid to Evans's campaign fund). This, second approach would be based on misrepresentation, concealment of a material fact, or fraud. This approach is based on the theory that, if Goldberg's contributors had wanted Evans (and Goldberg's many other recipients) to get contributions, those contributors would have given directly to Evans (and Goldberg's many other recipients).

    An interesting legal issue is whether a California politician's campaign committee is his alter ego, with the politician free to spend the committee's money any way he wants. Are contributions to a California politician's campaign committee his income? Could he use campaign contributions to help out any politiician, political group, or charity? Could he use campaign contributions to fix up his swimming pool (if his campaign office is not in his swimming pool)? In light of police and prosecution practices, are California election law restrictions (on how campaign funds may be spent) illusory? You may wish to consult with a California lawyer to find the answers to these questions.

    When a politiician runs for office, he either is confident that he'll win, or he isn't. If he isn't confident he'll win, he spends his money on his own campaign. What does he do with extra campaign funds if (like Fabian Nunez or Cindy Montanez) he's confident he will win his campaign? If he gives much money to a politiician who needs it, that receiving politiician probably will, if elected, be deeply grateful. (A friend in need is a friend indeed.) The contributing politician might want many favors after an election (for example: to become a party leader, to get on a powerful committee, or to get preferred legislation enacted). The contribution is made not to get elected, but to get benefits from other poltiicians after the election. This generalization does not necessarily apply to Goldberg, Evans, or anyone else in California. As shown below on this page, several politicians' campaign committees (not just Goldberg's) contributed substatially to Evans's campaign.

    Sadly, California police don't seem to know how (except by testimony of percipient witnesses) to find out if a politician's campaign committee gave money (to another politician's campaign committee) for a motive other than to win the first politician's election. Not only are California police unable to prove absence of a required motive to a jury (except by testimony of percipient witnesses), police cannot prove that absence even to themselves, it sadly seems. We don't know anyone who will teach. We are not being coy or sarcastic. We really don't know anyone who will teach.

    In general in California, prosecutors lack the integrity to take action against politicians who spend campaign funds improperly. Thus in California, the above-described police inability is harmless.

    Evans's husband is Mark Allen Fudem, born in 1956. According to the state bar's website, he now is an inactive California lawyer (number 102387), (Santa Rosa town, Sonoma county, CA 95404), (707). He is a worker's compensation administrative law judge employed by the state government of California, o fwhich his wife is a legislator.

          Geni [not Gene] A. Bennetts generously, politically contributed to several recipients in state and federal campaigns, including at least $2850.00 to the Noreen Evans campaign committee. He is a director (and seemingly a stockholder) of FCB bank, First California Bancorp, on the website of which his occupation is listed as "medical consulting". We don't know who his medical consulting clients are. First California Bancorp is related to, or the same as, CBC (Capitol Bancorp Ltd, a bank holding company listed on the New York Stock Exchange), First California Southern Bancorp, and FCNB (First California Northern Bancorp). As well as we can understand CBC form S-4 filed 17 June 2004, CBC owned 51 percent of FCNB, and Bennetts owned 11,000 shares (2.39 percent) of FCNB. According to what seems to be paragraph E-1 of that form S-4, FCNB common stock was then worth fifteen dollars per share (based on the terms of the proposed exchange of FCNB stock for CBC stock), so his FCNB stock was then worth $165,000.
          Bennetts is a director and was a president of a mental health organization, Family Service of Napa Valley: Geni A. Bennetts, M.D., Physician, gbennetts@sbcglobal.net.
          According to the Napa County Medical Society website on 31 October 2005, Bennetts is not in "active" practice: Geni A. Bennetts, MD; Pediatrics Hematology/Oncology; "Not in Active Practice". We've never heard of a doctor in passive practice, so we suspect that he has little or no practice. However, if he has little or no practice, how does he earn money? It is conceivable that he does not think of his medical consulting as the practice of medicine. Maybe he has investment income (related to FCB bank or its affiliates?). If he is not in "active" practice, why does he describe himself as a self-employed physician (for example, on his political contributions)?

          Together with someone else, he was a jeroboam member of Copia: Geni A. Bennetts and Patricia Tuck. The Mastagni law firm (California state bar certification provider number 9228) has represented CCPOA. The Mastagni firm's Sacramento office is several blocks from CAUSE's Sacramento office. Kasey Christopher Clark is a lawyer who, according to the state bar's web site, has an offic at the Cause office. Clark was a Mastagni firm lawyer (hired by the Mastagni firm in about 1990). He wrote an article with David E. Mastagni (who on 26 October 2005 is part of the Mastagni firm), "SUPERIOR COURT JUDGE ORDERS DEPARTMENT TO RELEASE WITHHELD SKELLY DOCUMENTS", published on a webpage in the LDF (Legal Defense Fund) directory (directory "ldf") in Porac's website. According to that article, two Mastagni firm lawyers (Kasey Clark and David E. Mastagni) seem to have have represented the same client in the same case: "... the Legal Defense Fund authorized David E. Mastagni and Kasey Clark, of Mastagni, Holstedt & Amick, to file a petition for alternative writ of mandate in Sacramento County Superior Court ...." in a case that seems to have involved officer Aaron Wyley.

        The Mastagni firm represents law enforcement and correctional officers and their organizations, other government officers and their organizations, and other clients. The firm's clientele seems to be chiefly Californian, as nearly as we can tell.

        The Porac-related LDF, which seems linked to the Mastagni firm (for example: LDF panel lawyers often are lawyers of the Mastagni firm, and the firm has represented Porac), seems, in our opinion, interested in cases in much of America west of the Mississippi River (not just California). As nearly as we can tell, an LDF panel lawyer defended in the Oakland Riders case.

        On 2 March 2004, when Noreen Evans was a member of the Santa Rosa City Council and a candidate for the Democratic party's nomination for state assembly, the city council held a closed session in the mayor's conference room (room 10) about existing litigation: "Name of case: People of the State of California; City of Santa Rosa, Real Party in Interest v. Industrial Waste & Debris Box Rentals, Inc., dba Industrial Carting [ex-URL ci.santa-rosa.ca.us/City_Hall/City_Council/Documents/ccm040302.htm] Sonoma County Superior Court No. 234220". The conference is item 3.2 of the city council's agenda for that day. In our opinion, it is unethical for a city council member to accept money from a corporation (or its owner or officer) while the city has a court case against that corporation, because acceptance of the money creates an actual conflict of interest. In some places (not necessarily Santa Rosa city or California), accepting such a payment is illegal. Evans got the $700.00 in two payments from this payor: one (maybe $200.00) about a month before the closed meeting, one (maybe $500.00) about five months after. If a member of a city council accepts money from a corporation litigating against the city, he should promptly disclose the money (for example, to the city's lawyer, the mayor, and the city council's members) and refrain from all proceedings involving that court case (for example, closed meetings at which the city's lawyer discusses the litigation with the city council). We don't know exactly when the court case began or ended (because the court doesn't put that information on the Internet), so we don't know if any MICHELINI (Industrial Carting) payment was accepted by Evans while the city was litigating against the payor.

He was co-chair of a fundraising committee which raised funds for the CAAA PAC (a PAC of an association of lawyers who represent people trying to get workers compensation). "The major purpose of this committee [that he co-chaired] is that of raising funds for the CAAA PAC and particular campaigns that are important to CAAA." By coincidence, Evans's husband is a workers compensation judge (as far as we know, in the same, small town in which Zanotto was a workers compensation lawyer). We don't know if Evans's husband decided any of contributor Zanotto's cases. The contribution above was Zanotto's own money, not money of the committee, CAAA, or the PAC.

        If Zanotto bought things for the judge's wife (a vacation trip to Nevada, for example), we guess that would disqualify the judge from deciding Zanotto's cases unless the opposing litigant made a knowing waiver. . We don't know if the judge went on that Nevada vacation (although the campaign committee seems to have paid some of his travel expenses). If Zanotto paid for the judge to go to Nevada on vacation, we guess that that would disqualify the judge from Zanotto's cases unless the opposing side made a knowing waiver. The campaign committee paid money for the judge and his wife-candidate without legally required (in our opinion, as well as we understand) disclosures. It would be easy to get a list of all lawyers whose cases were decided by the judge, then see which of them (and the litigants and real-party-in-interest-insurers that those lawyers represented) contributed to the Evans slush fund (which, in our opinion, is what the campaign fund seems chiefly to have been). The campaign got money from other lawyers who practice before the judge, we think (not jsut Zanotto). When the campaign fund disburses money to the judge's son, and for the judge and his wife (particularly when the disbursements are not fully disclosed as required by law), we feel (although we are not expert in this area of law) that fairness requires that the judge be forbidden to decide any cases involving contributors (regardless of whether the contributors are lawyers, litigants, or insurance companies which are real parties in interest) absent a knowing waiver. We feel that, if the judge decided cases involving contributors to the campaign fund, those decisions should be retroactively canceelled and then re-decided by an impartial judge except where there were knowing waivers. This is not merely a judge whose wife's campaign fund gets contributions. Here, the campaign fund paid the judge's son and seems to haave dubiously paid expenses of the judge's wife and the judge (which payments are not necessarily properly disclosed campaign expenditures).

        In analyzing all of this, we need to remember that California is a community property state, which means that the judge owns half of his legislator-wife's earnings. Therefore, when a contributor (an insurance company, perhaps) contributes to the Evans campaign to be elcted to the legislature, that contributor is an attempt to generate income for the judge.

        We don't know what disclosures, if any, the judge made (andnow makes) to litigants before him. In our opinion, to be fair to the litigants, the judge needs to disclose, among other things, all benefits from the campaign fund to his son, his wife, and himself.

        There is a body of law concerned with conflict of interest and recusal of administrative law judges in California. We are not expert in that body of law. If you have any questions about what we write here (or anywhere else in this website), talk with an expert.

        In her campaign for the state legisalturre, money sometimes moved from Evans to the CDP (California Democcrtic party) and sometimes from the CDP to her. We don't know why any of the payments were made. Sometimes, some people (never us) metaphorically call politicians "whores". Some whores turn over much money to their pimps, and some pimps occasionally buy small gifts for their whores. Evans, in her first campaign for the state legislature, paid over twenty-six thousand dollars to the CDP. Now and then, the CDP paid a little to her; for example the $595.61 payment mentioned a little above. Some pimps bring customers to their whores. Nomination by the CDP will bring votes to the nominated candidate. If Evans is a whore, the CDP is her pimp. We don't find the whore metaphor analytically useful.
        It would be interesting to know if any of the contributions she received were earmarked for her to pay to the CDP. In other words, it would be interesting to know if some contributors paid her money with the understanding that she would transfer those paymetns to the CDP.
        We don't know why the CDP paid $595.61, rather than some other sum, to her.
